- 1. The subject of the order is: renewal of the subscription to SAN switch management software for a period of 60 months.
2. The subject of the contract is described in detail in Chapter II of the SWZ - Description of the subject of the contract (OPZ).
3. All requirements specified in Chapter II SWZ - OPZ constitute minimum requirements and their fulfillment is obligatory. Failure to meet the above-mentioned minimum requirements will result in rejection of the offer pursuant to Art. 226 section 1 point 5 of the Public Procurement Law, as inconsistent with the terms of the order.
4. Pursuant to Art. 139 of the Public Procurement Law provides for a reverse order of assessment offers, i.e. it will first examine and evaluate the offers, and then subjectively qualify the Contractor whose offer was rated the highest in terms of the lack of grounds for exclusion and compliance with the conditions for participation in the proceedings.
5. The Ordering Party is the administrator of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27/04/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter referred to as "GDPR".
6. The order was not divided into parts due to its uniform nature in technical and functional terms. The Ordering Party does not allow the submission of partial offers for technical and implementation reasons and rational spending of public funds.
