Description:
1. The subject of the order is the successive delivery of non-alcoholic beverages to military units and training ground centers in accordance with the assortment and quantity list contained in Chapter IV - "Description of part of the order" SWZ and in the "Form "offer" constituting Annex No. 1 to the SWZ. 2. Pursuant to Article 441 section 1 of the Public Procurement Law, the Ordering Party provides for the possibility of exercising the "Option Right". The "Option Right" will be implemented under the same conditions and deadlines as the basic order. Contractors in in the event of failure to exercise the "Option Right", as to the scope of unrealized deliveries specified in the tables in Chapter IV of the ToR, in the column called "option quantity", there are no claims against the Ordering Party, including in particular claims for payment of expected benefits. The "right of option" means that the ultimately ordered quantity of the subject of the order will depend on the current demand of the Ordering Party. About the intention to exercise the "Option Right", along with the quantity of the subject of the order and the place of its delivery, the Ordering Party will inform the Contractor within the deadline specified in the "Drafted provisions of the contract" constituting Annex No. 5 to the SWZ. 3. The Ordering Party does not allow the use of substitute packaging for products during the execution of the contract food products that are the subject of the proceedings. 4. The Contractor is obliged to inform the Ordering Party in writing about any change in the presence of allergens in the delivered products. 5.The contractor is responsible for...
