- 12 The parts offered must:
- strictly meet the requirements specified inAnnex 2.1 to SWZ,
- be original, brand new, free from defects, meet the relevant quality requirements and the requirements of European standards or Polish standards transferring European standards, as well as not burdened with the rights of third parties,
- meet the requirements set out in the contract template.
3. For grantingOrders may apply for contractors who:
1) are not subject to exclusion in the circumstances referred to in art. 108 para. 1 of the Public Procurement Law, with the proviso that in the proceedings the contractor is not subject to exclusion in the case referred to in art. 1 point 1 lit. h of the PZP Act, and in the case ofreferred to in art. 108 para. 1 point 2 of the Public Procurement Law, if the person referred to in this provision was convicted of the crime listed in art. 1 point 1 lit. h of the Public Procurement Law, in addition, they are not excluded in the circumstances referred to in:
