1. Because the implementation of this order must be carried out by performing the activities in conditions referred to in Art. 22 § 1 of the Act of June 26, 1974, Labor Code - for the benefit of the contractor or subcontractor, at the place and time indicated by the contractor or subcontractor - the ordering party, in accordance with Art. 95 section 1 of the Public Procurement Act requires the contractor or subcontractor to employ persons performing the work activities included in the so-called direct costs based on the employment relationship. This requirement applies to persons who perform activities directly related to the provision of winter maintenance services for municipal roads that are the subject of the contract.
