Description:
1. The subject of the order is the purchase of gas fuel by the Ordering Party and their organizational units. A detailed description of the subject of the order is included in Annex No. 2 to SWZ - Description of the subject of the order.
2. The Contractor will make all actions and arrangements with the DSO necessary to carry out the procedure changing the supplier and effective commencement of gas fuel sales, including in particular: termination of existing comprehensive agreements, notification of new gas fuel sales agreements to the DSO. These activities will be performed by the Contractor on the basis of appropriate powers of attorney granted upon conclusion of the contracts sales of gas fuel.
3. The supply of gas fuel will be based on contracts concluded separately by individual Ordering Parties and by local government organizational units, which will be separate payers and which are indicated in Annex No. 2 to the SWZ.
4. Delivery of gas fuel will take place under the conditions specified in the Energy Law Act of April 10, 1997 (consolidated text: Journal of Laws of 2024, item 266, as amended) and based on the implementing provisions of this Act, in particular the Regulation of the Minister of Economy of July 2, 2010 on detailed conditions functioning of the gas system (Journal of Laws of 2018, item 1158, as amended) Regulation of the Minister of Energy of March 15, 2018 on detailed rules for shaping and calculating tariffs and settlements in gas fuel trade (Journal of Laws of 2021, item 280, as amended), in accordance with the tariff d...
