Description:
The subject of the Order is the design (if necessary, the execution of replacement Construction Designs) and construction of a set of cogeneration units in the city of Wołomin, by connecting cogeneration heat sources in four locations in Wołomin. More information in point 5.1. announcements. 1. The procedure is conducted as an open tender pursuant to Art. 376 section 1 point 1 of the Act of 11 September 2019 Public Procurement Law (consolidated text: Journal of Laws of 2024, item 1320) - hereinafter referred to as "Pzp" or "Pzp Act" and implementing acts to the Pzp Act, with which: 1) The Ordering Party provides for the possibility of exercising the Option Right under this tender in accordance with Art. 441 Pzp. Exercising the Option Right is the exclusive right and not an obligation of the Ordering Party. The Contractor is not and will not be entitled to any claims in the event that The Ordering Party will not exercise the Option Right or will exercise it to a lesser extent than indicated
2) The Ordering Party will be entitled to exercise the Option Right in the event of an increased
demand for the Contractor's services during the implementation of the Service Agreement, but no longer than until completion a period of 6 years from the date of signing the Final Acceptance Protocol under the Execution Agreement. 3) The Ordering Party will have the right to exercise the Option Right after submitting a written notification to the Contractor no later than 1 month before the limit of 40,000 mth is reached by the first of the Facilities covered by Agreement...
