Description:
1. The subject of the order is a successive (depending on the current needs of SZGKiM in Pśniewo) delivery of diesel oil in the amount of 40,000 liters to the vehicles of the Local Government Zakład Gospodarki Komunalnych i Mieszkaniowej in Pśniewo, carried out in the form of non-cash payments. refueling at gas stations indicated by the Contractor.2. The Ordering Party reserves the right to exercise the option right specified in Art. 441 of the Public Procurement Law, i.e. purchase of larger quantities of diesel oil (up to 20% of the basic order quantity) depending on demand resulting from difficult-to-predict market conditions and a possible change in the number of the Ordering Party's vehicles during the term of the concluded contract. Failure by the Ordering Party to perform the contract in the scope of the option right does not require giving reasons and does not constitute a basis his liability for non-performance or improper performance of the contract. Detailed regulations regarding the Ordering Party's exercise of the option right are included in the contract no. 5, the template of which is attached as Annex No. 3 to SWZ.3.
