Description:
The subject of the order was divided into 4 packages (tasks), i.e.
Package and assortment used during surgery 1 (Annex 2.1.)
Package II assortment used during surgery 2 (Annex 2.2.)
Package III The assortment used during surgery 3 (Annex 2.3.)
Package IV disposable medical products made of non -woven and gauze,
Treatment sets 4 (Annex 2.4.)
1. The contracting authority reserves the right to change the number of individual elements of the subject of the contract and specified in Annex 2 (from 2.1 to 2.4) to this contract, namely:
a) unilateral reduction of the size of the order in a particular position within a given part of the subject of the contract (each assortment) with a maximum of 30% of the amount included in the assortment and price form,
b) increasing the amount of one item, compensating it reduction of the number of a different item within a given package (part) while maintaining the unit prices contained in the given assortment and price form without changing the value of the contract referred to in § 2 para. 2 of this contract.
2. The Contractor is not entitled to a claim for the Ordering Party not using the quantity scope of the contract and not using the entire value of the contract. The contracting authority's failure to use the contract does not require any reasons and does not cause compensation obligations in this respect.
