Description:
1. The subject of the Order is the supply of mechanical parts for Varsovia metro vehicles (hereinafter also referred to as "mechanical parts") in 2025-2026, divided into 12 Tasks.
2. The scope of the Subject of the Order includes the delivery of parts as part of the individual tasks indicated in the "Schedule ordered parts" constituting Annex No. 1 to the Technical Specification (hereinafter referred to as "TS"), constituting Annex No. 1 to the SWZ and being an integral part thereof.
3. The Subject of the Order will be completed in accordance with the procedure documentation, i.e.: SWZ and its annexes, in particular ST and the template contract (Annex No. 2 to the SWZ).
99 section 4 of the Public Procurement Law, i.e. without indication of trademarks (manufacturer's catalog numbers), and the use of the manufacturer's catalog numbers is justified by the specificity of the Subject Orders.
Taking the above circumstances into account, in accordance with Art. 99 section 5 of the Public Procurement Act, the Ordering Party allows the submission of an offer for parts equivalent to the original parts indicated by the Ordering Party in Annex No. 1 to the ST. If equivalent parts are offered, they must have the following characteristics the same parameters as the original parts, while meeting the functional requirements of the original parts and will be compatible with other elements of the vehicle.
