Description:
1. The subject of the Order is the supply of rotating components for Varsovia metro vehicles (hereinafter also referred to as "parts"), divided into 6 tasks.
2. The scope of the Subject of the Order includes the delivery of parts as part of the individual tasks indicated in the "List of ordered parts" constituting Annex No. 1 to the Technical Specification, constituting Annex No. 1 to the SWZ and constituting its integral part (hereinafter referred to as "TS").
3. The Ordering Party requires the implementation of the Subject of the Order in the scope of tasks No. 2, 3 and 6 in 2 batches, according to the delivery schedule and in the quantities indicated in Annex No. 1 to the ST. In tasks No. 1, 4 and 5, the Contractor is obliged to deliver in one batch within the dates and quantities specified in Annex No. 1 to the ST. A maximum of two partial deliveries are permitted per batch.
4. The Subject of the Order will be completed in accordance with the documentation proceedings, i.e.: SWZ and its annexes, in particular the ST and the contract template (Appendix No. 2 to the SWZ).
5. Whereas:
1) As a result of the resolved public procurement procedure conducted in an open tender, the Ordering Party purchased Varsovia metro vehicles from Škoda Transportation Group (which is a constructor and manufacturer of vehicles) without a license to produce them (due to the costs of such proceedings) along with the certificate of admission to operation of the vehicle type No. PL 59 2023 0059, issued by the President of the Office of Rail Transport.
