3 2The contractor, whose offer was rated the highest, regarding the lack of grounds for exclusion and meeting the conditions for participation in the procedure (Article 139 (1) of the Public Procurement Law). 3. In connection with the application of the procedure under art. 139 para. 1, the Ordering Party does not require submitting a statement referred to in Article 125paragraph 1upzp. 4. Pursuant to art. 257 points 1 of the PPA, the Employer reserves the right to annul the proceedings. 5. The Employer does not provide for orders pursuant to art. 214 para. 1 POP. 6.The contracting authority does not carry out preliminary market consultations.
