- 1. The subject of the order is to equip the reserve bay no. 206 at the 220 kV switchgear in SE Joachimow for the connection of MEE Turow. A detailed description of the subject of the order can be found in Part II of the SWZ Functional and Utility Program.3. Each time, in all cases in which the Ordering Party describes subject of the contract by reference to the standards, technical assessments, technical specifications and technical reference systems referred to in Art. 101 section 1 point 2 and section 3 of the Act, the Ordering Party allows solutions equivalent to those described, if they allow to obtain features or parameters that are no worse than recalled. The above means that the contractor may use the solutions described by the Ordering Party "or equivalent".
4. Pursuant to Art. 101 section 5 of the Act, the Contractor who refers to solutions equivalent to those described by the Ordering Party is obliged to demonstrate that the supplies he offers, services or construction works meet the requirements specified by the Ordering Party, provided that the Contractor proves in the offer, in particular by means of evidence referred to in Art. 104-107 of the Act that the proposed solutions
they meet the specified requirements to an equivalent extent in the description of the subject of the order. 5. Pursuant to Art. 18 section 2 in connection with Art. 133 section 3 of the Act, the Ordering Party establishes requirements regarding the confidentiality of information provided to Contractors in the course of the procedure.
