Pursuant to Art. 17 section 1 point 15 of the Act of March 12, 2004. on social assistance (uniform text: Journal of Laws of 2025, item 1214), the obligatory tasks of the commune include performing funerals, including for homeless people. The obligation to perform burials by the Social Welfare Center results from Art. 10 section 3 of the Act of January 31, 1959. on cemeteries and burial of the dead (uniform text: Journal of Laws of 2024, item 576) and the Regulation of the Minister of Health of December 7, 2001 on the treatment of bodies and human remains (uniform text: Journal of Laws of 2021, item 1910).2. Pursuant to Art. 44 According to the Act on Social Assistance, the funeral is carried out in the manner established by the municipality, in accordance with the religion of the deceased. Order No. 1515/09 of the Mayor of the City of Gdask of October 13, 2009 regarding the organization of a funeral by the Municipality of Gdask in municipal cemeteries located in the City of Gdask, specifies the scope of cemetery and funeral services.
