- 1. The subject of the order is the purchase of 15 ABC (Automated Border Control) biometric gates - an automatic border control system. The description and method of execution of the order are included in the Description of the Subject of the Order (OPZ), constituting Annex No. 2 to the SWZ. 2. Whenever in the content of the SWZ, including the Description of the Subject of the Order, constituting Annex No. 2 to the SWZ, the subject of the contract is described by indicating trademarks, standards, patents or the source of a detailed process, the Ordering Party allows the offer by the Contractor of an equivalent solution. 3. The Contractor who refers to solutions equivalent to those described by the Ordering Party is obliged to demonstrate that the equipment he offers meets the requirements specified in the Description of the Subject of the Order. constituting Annex No. 2 to the SWZ. Equivalence in terms of technical, functional or operational parameters is intended in particular to ensure that technical parameters are not worse than those adopted by the Ordering Party. 4. Where in the Description of the Subject of the Order or other procurement documents, the trademark (brand), manufacturer, supplier, patent, origin, source or specific process that characterizes the products or services provided by a specific Contractor or standards, European technical assessments, common technical specifications or other references referred to in Art. 101 section 1 point 2 or section 3 of the Act, Public Procurement Law (PZP), the Ordering Party agreed...
