Description:
Purchase and delivery (to the Municipal Social Welfare Center in Sosnowiec) of a file server with disks, in accordance with the scope specified in Annex 1. The delivered equipment should be brand new (not used or previously regenerated). Equipment is subject to conformity assessment and should be marked with the CE mark, free from technical and legal defects. The Contractor will provide accessories necessary for the proper operation of each device together with the offered device (if applicable). The Contractor will deliver to the Ordering Party the subject of this contract in a ready-to-use condition, i.e. complete and configured ready for operation. The contractor will deliver the subject of the contract along with operating instructions in Polish. The Public Procurement Law does not apply to orders and competitions whose value does not exceed the PLN equivalent of PLN 130,000 net. The Ordering Party is of the opinion that the wording "The Act does not apply" means that the contracts referred to in the first sentence do not apply to the provisions of the Public Procurement Act apply, including those relating to the description of the subject of the contract. The Ordering Party bases the above position on the jurisprudence of the National Chamber of Appeal, e.g. the decision of January 30, 2013, KIO 94/13, the decision of March 17, 2009, KIO/UZP 260/09, or the resolution of February 11, 2016, KIO/KD 14/16.
