3. The subject of the order is: purchase and delivery of a brand new backhoe loader. On the delivery date, the operating and maintenance instructions for the backhoe loader, devices and equipment installed in the backhoe loader must be provided in Polish, warranty books and equipment, approval certificate and a set of documents necessary to register a backhoe loader.4. The detailed specifications of the vehicle are set out in Annex No. 8 to SWZ.5. Other requirements of the Ordering Party: 1) The Contractor undertakes to provide the Ordering Party with a brand new backhoe loader with equipment, hereinafter referred to as the excavator in accordance with with the Specification of Order Conditions, its annexes and the contracts. 2) The Contractor declares that the subject of the order referred to in point 1: a) is brand new, complete, free from construction, material and workmanship defects, ready for registration and use for the purposes arising from the Agreement, b) is not limited by the rights of third parties, is not the subject of any proceedings or security (the contractor has full right to dispose of it), 3) Upon delivery of the subject of the order, the Contractor undertakes to transfer it to the Ordering Party of...
