Description:
1. The subject of the contract is the delivery of the HA servers cluster with the software and the delivery of a guaranteed UPS power source at the Nursing Home in Mielec as part of the "Cyberse -safety local government" project with minimal parameters and requirements in accordance with the description of the subject of the contract constituting Annex 1 to SWZ.
2. The concise description of the subject of the contract, including the minimum requirements regarding the subject of the contract, include Annex 1 to SWZ and the draft contract constituting Annex 4 to SWZ.
3.5. The present proceedings in the awarding authority's assessment lack actions in the scope of execution of the order, the performance of which consists in performing work in the manner specified in art. 22 § 1 of the Act of June 26, 1974, Labor Code (Journal of Laws of 2023, item 1465 and of 2024, items 878 and 1222), therefore, in connection with the circumstance of the fact that the order applies to deliveries, the contracting authority does not determines on the basis of art. 95 para. 1 of the Act, requirements for employment by the Contractor or subcontractor of persons performing the contract under an employment contract.
