139 section 2 PPL provides for the request for a declaration referred to in Art. 125 section 1 PPL only from the contractor whose offer will be rated the highest. The Contractor submits the declaration in question in the form of the European Single Procurement Document (ESPD), constituting Annex No. 2 to the Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form for the single European order document. The information contained in the ESPD constitutes preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings.
