Description:
1. It is possible to invalidate the procedure as a result of failure to allocate funds to finance the order. Pursuant to Art. 257 of the Public Procurement Act, the contracting authority may invalidate the contract award procedure if the public funds that the contracting authority intended to allocate to finance the entire or part of the contract, were not awarded to him, and the possibility of invalidating the procedure on this basis was provided for in the contract announcement.
139 section 1 of the Public Procurement Law, it will first examine and evaluate the offers (for each part), and then make a subjective qualification of the contractor whose offer was rated the highest in terms of the lack of grounds for exclusion and the fulfillment of the conditions for participation in the procedure.
