Description:
1. The Ordering Party commissions and the Contractor accepts work consisting in the renovation of external lighting at the Gdynia Cisowa Postojowa station, together with the right to option in the scope of this task.1) The guaranteed scope of the order includes: replacement of fixtures lighting, booms and lighting poles at the Gdynia Cisowa Postojowa station in accordance with the description of the subject of the order (OPZ)2) The scope of the order covered by the option law includes: verticalizing the lighting pole no. 3/6 in accordance with the description subject of the order (OPZ) The Ordering Party may exercise the option right in full or not. Exercising the option right is a unilateral right of the Ordering Party. Failure by the Ordering Party to exercise the option right shall not result in liability for the Contractor no claims against the Ordering Party. The rules regarding the implementation of the scope of the contract covered by the option right will be the same as those applicable to the implementation of the guaranteed scope of the contract. Rules for determining prices for the guaranteed range the order and the scope of the order covered by the option right are included in this ToR. A detailed description of the option right, including the circumstances of exercising the option right, is described in the Draft Agreement constituting Annex No. 2 to this ToR.
