Description:
1. The subject of the contract is the service of the protection of the facilities of Enea Ciepło sp. Z o.o.
95 para. 1 of the Public Procurement Law, the contracting authority requires that persons performing activities that make up the protection service, during the performance of the contract, be employed on the basis of an employment contract throughout Period of order processing If the performance of these activities consists in performing work in the manner specified in art. 22 § 1 of the Act of 26 June 1974 - Labor Code. Detailed employment rules are set out in the contract template - Annex 5 to SWZ. The requirement to employ the persons indicated above for the contract for work applies to both the contractor and subcontractors participating in the performance of the contract. The burden of proving this requirement will rest with the contractor.
3. Employment under an employment contract does not apply to employees of the intervention group.
4. The Ordering Party, acting on the basis of art. 131 paragraph 2 of the PZP requires a local vision to familiarize yourself with the place of implementation of the subject of the contract. The application for a local vision should be sent to the e-mail address: zbigniew.dudzinski@enea.pl by 07.08.2025.
