Description:
1. The subject of the order is the successive delivery of fuel:
Armii Krajowej 4, 22-100 Chełm,
Dorohuska 70, 22-100 Chełm.
2.Total quantity (maximum) of the subject of the order is:
•diesel oil (B7) in a maximum quantity of 3,400,000 liters,
•diesel oil (B0) in a maximum quantity of 420,000 liters,
•lead-free ethylene Pb 95 (E10) in a maximum quantity of 2,300,000 liters,
• lead-free ethylene Pb 98 (E5) in a maximum quantity of 340,000 liters.
3. The Ordering Party guarantees the implementation of the subject of the order at the level of:
•diesel oil (B7) in the amount of 2,000,000 liters,
•diesel oil (B0) in the amount of 250 000 liters,
The remaining quantity will be implemented depending on demand, as part of the exercise of the option right, on the terms and conditions described below:
a) The Ordering Party may exercise the option right described in the ToR in whole or in part;
b) The order implemented under the option is a unilateral right of the Ordering Party, therefore, failure to exercise the option right by the Ordering Party does not constitute a basis for the Contractor to pursue any claims against the Ordering Party;
c) The Contractor will be obliged to perform the order covered by the option right after receiving notice from When ordering...
