Description:
1. The subject of this order are successive supplies of reagent to detection and diagnostics from Illumina or equivalent, specified as to the type and quantity in the assortment and price form, constituting Annex 2 to SWZ, subject to paragraph 2 and next.
2. Subject Orders specified in Annex 2, was drawn up on the basis of an analysis of the delivery of rejection for detection and diagnostics of the Illumina, and made in the last 24 months, taking into account the quantitative changes necessary for the implementation of scientific and research programs, whose continuation requires the absolute use of reagents of the same manufacturer or producer of "equivalent" reagents referred to in para. 3.
3. Considering the specificity of the subject of the contract (reagents for detection and diagnostics from Illumina) and the resulting impossibility to clearly describe the criteria equivalences that cannot be described in a precise way, pursuant to art. 99 para. 5 and 6 of the Act, a contractor who refers to "equivalent" products (other manufacturer than Illumina) specified in the assortment and price form (Annex 2 to SWZ), is obliged to
demonstrate by submitting together with the offer of the subjective measures referred to in branch 5 of the Act, in accordance with the provisions of Chapter XI SWZ, that the reagents he offers (each one) meet the requirements allowing for the continuation of scientific and research programs without Horses ...
