Description:
The subject of the order are the successive deliveries of medicines (hereinafter referred to interchangeably as goods or assortment) by the Contractor of the type and quantities specified in the price form constituting Annex No. 2 to the SWZ and in accordance with the draft provisions of the contract constituting Annex No. 4 to this SWZ.
If there is no demand for the product range covered by the subject of the contract, the Ordering Party reserves the right not to order part of the product range specified in Annex No. 2 to the SWZ, subject to section 4. The Contractor is not entitled to any claims for damages or claims in this respect based on another legal basis, to which the Contractor consents.
The Ordering Party guarantees that the minimum value of supplies for a given task
will be 75% the maximum value of the Contractor's remuneration for this task specified

The medicines offered by the Contractor must be:
1) approved for marketing and use in Poland or must have a one-time permit from the Ministry of Health,
2) registered as a medicine with a registered indication for the treatment and prevention of bone and soft tissue infections - concerns task no. 18, item 5 and 6
3) brand new, without signs of use, full value and complete,
4) meet the quality requirements and properties specified by the Ordering Party and the manufacturer,
5) packed in accordance with the registration documentation (original packaging) and in accordance
