Description:
1. Subject of the order: "SUPPLY OF ENDOPROTHETSES" described in detail in Annex No. 2 to this SWZ - individual packages.
2. Scope of the subject of the order: The goods offered by the Contractor must:
a) correspond to Polish standards transposing European standards or standards of other European Member States Economic Area transferring these standards.
b) have valid documents allowing for marketing authorization in the territory of the Republic of Poland in accordance with the provisions of the applicable Act of April 7, 2022 on medical devices, its transitional and implementing provisions, and EU Regulation 2017/745 on medical devices - MDR (if the law imposes an obligation to have such documents) - if it applies to a given product,
c) meet the requirements specified by the Ordering Party in the Terms of Reference, in particular the conditions specified in the description of the item orders.
3. The contractor will provide current documents confirming that the offered subject of the order is compliant with the Act on Medical Devices of April 7, 2022 and approved for marketing and use in health care (CE certificates / declarations of conformity) in accordance with the class of the medical device or an appropriate declaration that the provisions of the above-mentioned Act do not apply to a given product, together with the attachment of other documents confirming that the product is authorized for marketing and use in the European Union, when their submission is necessary on the basis of separate recipe...
